Seatbelts

When the vehicle is moving forward it is compulsory for children and adults to wear a seatbelt but it only covers people who are 3 years of age and older.

If the rear-seat is fitted with seatbelts, passengers occupying these seats must wear such seatbelts while the vehicle is in motion.

Persons between the ages of 3 and 14 years are regarded as a child, however if such person is taller than 1.5 metres then he/ she is regarded as an adult irrespective of age. An adult is a person older than 14 years.

Adults should not:

• Occupy a seat in any vehicle unless he/ she wears a seatbelt.

• Occupy a seat on a row of seats that are not fitted with seatbelts, unless when all seats fitted with seatbelts on that row are already occupied.

Children

The motor vehicle driver must make sure that a child seated on a seat:

• Uses an appropriate child restraint, where it is available.

• Wears a seatbelt if no children restrain is available.

The driver must make sure the child seats on the rear seat if there are no seats equipped with seatbelts in that vehicle.

You are not required to wear a seatbelt while reversing or moving in or out of a parking bay or area.

The vehicle driver must make sure all people travelling in the vehicle wear seatbelts.

Protective Helmet for Motorcycle Rider

On a public road you are not allowed to ride on any type of a motorcycle or be a passenger on type of a motorcycle unless you wear a protective helmet:

• Which is specially designed for that particular cycle.

• Which fits properly and the chin strap fastened under the chin.


The motorcycle rider must make sure that any passenger who is younger than 14 years wears a protective helmet.

If the motorcycle is equipped with seatbelts that complies with the SABS, and when the engine cannot move unless the rider and passenger of the motorcycle wear such seatbelt, then the rider and passenger may not wear a protective helmet.
